Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and Green Card Genius LLC, a Wyoming limited liability company (“Clipstorm”, “we”, “us”, or “our”), governing your use of Clipstorm, our automated short-form video creation and publishing service (the “Service”). By using the Service, you agree to these Terms. You must be at least 18 years old to use the Service.

1. The Service

Clipstorm helps you produce short-form videos — generating scripts, voiceover, b-roll, and captions — route them through a review queue for your approval, and publish approved videos to social platforms you connect. The Service assembles and publishes content based on the inputs you and your workspace provide. Features may change over time, and we may add, modify, or discontinue parts of the Service.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

3. Your Content and License to Us

You retain ownership of the content you provide and the videos generated for you (“Your Content”). You grant us a non-exclusive, worldwide license to host, process, reproduce, modify (for formatting and rendering), and transmit Your Content solely to operate and provide the Service, including publishing it to the platforms you connect.

You represent and warrant that you have all rights necessary to your inputs and to publish Your Content — including any footage, images, audio, music, trademarks, and third-party material — and that Your Content does not infringe any rights or violate any law. You are solely responsible for what you approve and publish.

4. Third-Party Platforms

The Service publishes to third-party platforms such as YouTube, Instagram, TikTok, and Facebook. Your use of those platforms is governed by their own terms and policies, and you are responsible for complying with them. When you connect an account, you authorize us to act on your behalf for the features you enable.

Clipstorm is not affiliated with, endorsed by, or sponsored by YouTube, Google LLC, Meta Platforms, Inc., or TikTok. All product names, logos, and brands are the property of their respective owners.

5. Acceptable Use

You agree not to use the Service to:

create or publish content that is unlawful, infringing, deceptive, or violates a platform’s policies;
impersonate any person or entity or misrepresent your affiliation;
upload malware, scrape the Service, or attempt to reverse engineer or circumvent it;
use the Service to spam, or to generate content at a scale or in a manner that violates platform rules.

6. Intellectual Property

The Service, including its software, design, and content we provide, is owned by us or our licensors and protected by intellectual property laws. We grant you a limited, revocable, non-transferable license to use the Service in accordance with these Terms. You may not copy, resell, or create derivative works from the Service, or use it to train competing models.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted or error-free, that generated content will be accurate or suitable, or that a third-party platform will accept, retain, or continue to display your content.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLIPSTORM WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS. OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).

9. Indemnification

You agree to indemnify and hold harmless Green Card Genius LLC and its officers, employees, and agents from any claims, damages, and expenses (including reasonable legal fees) arising out of Your Content, your use of the Service, or your violation of these Terms or any third-party rights or platform policy.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. On termination, the licenses you granted for content already published remain as necessary for that published content.

11. Governing Law; Arbitration; Class Action Waiver

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-laws rules. Before filing a claim, you agree to first contact us at info@greencardgenius.com to attempt an informal resolution.

Any dispute that cannot be resolved informally will be settled by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, on an individual basis. You and we waive any right to a jury trial and to participate in a class action. You may opt out of arbitration by sending written notice to the address in Section 13 within 30 days of first accepting these Terms.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by an updated “Last updated” date and, where appropriate, additional notice. Your continued use of the Service after a change takes effect means you accept the updated Terms.
